2. Registration and Account Management

2.1 Account Creation

To access our Services, you may be required to create an account by providing:

For Job Seekers and Candidates:

  • Personal information (name, address, email, phone number)

  • Professional information (resume, employment history, skills)

  • References and contact details

  • Salary expectations and job preferences

For Business Clients:

  • Company information (business name, industry, contact details)

  • Hiring requirements and role specifications

  • Budget and timeline expectations

  • Authorised contact persons

2.2 Account Security

You agree to:

  • Keep your login credentials confidential

  • Notify us immediately of any unauthorised access

  • Not create multiple accounts

2.3 Eligibility Requirements

You may not use our Services if:

3. User Obligations and Conduct

3.2 Professional Conduct

All Users agree to:

  • Provide reasonable notice if circumstances change

  • Maintain confidentiality of client information

Additional Obligations for Business Clients:

  • Treat candidates fairly and professionally during the hiring process

  • Honour agreed terms and payment obligations

3.3 Prohibited Activities

All users must not:

  • Provide false or misleading information

  • Use our Services for unlawful purposes

  • Attempt to circumvent our placement processes

  • Engage in any conduct that could damage our reputation

Additional Prohibitions for Candidates:

  • Solicit other candidates or clients directly

  • Apply for the same role through multiple channels

Additional Prohibitions for Business Clients:

  • Contact candidates directly to bypass our services

  • Use candidate information for purposes other than the specific hiring process

4. Placement Process and Terms

4.1 Candidate Submission

When we submit your profile to a potential employer:

  • We will seek your consent before each submission

  • You remain associated with us for that role for 12 months

  • We will provide you with relevant job details and requirements

  • You may decline opportunities at your discretion

4.2 Interview Process

During the interview phase:

  • You must attend all scheduled interviews

  • Provide reasonable notice if you cannot attend

  • Conduct yourself professionally

  • Provide honest feedback about the opportunity

4.3 Job Offers and Acceptance

When you receive a job offer:

  • You must notify us within 24 hours of any offers received

  • We will assist with negotiation where appropriate

  • You remain free to accept or decline offers

  • Once accepted, you commit to the position

4.4 Placement Protection Period

Once placed in a role:

  • A 12-month association period applies between you and us

  • You agree not to work with other recruitment agencies for the same employer during this period

  • This protects our commercial relationship and ensures proper service delivery

5. Fees and Payment Terms

5.1 Candidate Fees

Our services to candidates are provided at no cost. We do not charge candidates any fees for:

  • Registration and assessment

  • Job searching and placement services

  • Interview preparation and coaching

  • Ongoing career support

5.2 Employer Fees

Employers pay placement fees upon initiating and/or successful hiring

  • Payment Terms: 7 days from candidate start date

5.3 Replacement Guarantees

For permanent placements, we provide replacement guarantees:

  • Conditions apply as detailed in our client agreements

6. Confidentiality and Non-Disclosure

6.1 Confidential Information

You acknowledge that through our Services you may access confidential information including:

  • Client company details and strategies

  • Other candidates' information

  • Our business methods and client relationships

  • Salary and remuneration details

6.2 Confidentiality Obligations

You agree to:

  • Keep all confidential information strictly confidential

  • Not disclose information to third parties

  • Use information solely for the intended placement purposes

  • Return or destroy confidential information upon request

6.3 Duration

Confidentiality obligations continue indefinitely, even after termination of our relationship.

7. Non-Solicitation and Non-Compete

7.1 Client Non-Solicitation

You agree not to, for 12 months after placement:

  • Directly approach our clients for employment opportunities

  • Encourage other candidates to approach our clients directly

  • Bypass our services when dealing with introduced clients

7.2 Team Member Non-Solicitation

You agree not to solicit our employees or contractors for employment with other organisations for 12 months after termination of our relationship.

7.3 Reasonable Restraints

These restraints are reasonable and necessary to protect our legitimate business interests.

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content on our Website and in our Services is protected by intellectual property laws, including:

  • Website design and functionality

  • Proprietary assessment tools

  • Training materials and resources

  • Business processes and methodologies

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use our Services for their intended purpose only.

  • We make no guarantees about placement success

  • We cannot control employer decisions or market conditions

  • Job availability and requirements may change

  • We provide Services "as is" without warranties

9.2 Limitation of Liability

To the maximum extent permitted by law, our liability is limited to:

  • Re-supply of Services where required under consumer guarantees

  • Direct damages only (no indirect or consequential damages)

  • Amount paid for Services in the preceding 12 months (for clients)

  • Zero liability for candidates (as no fees are charged)

9.3 Consumer Guarantees

Nothing in these Terms excludes rights under the Australian Consumer Law where such exclusion would be unlawful.

9.4 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

10. Data Protection and Privacy

10.1 Privacy Compliance

We collect, use, and protect your personal information in accordance with:

  • The Privacy Act 1988 (Cth)

  • Other applicable privacy laws

10.2 Data Sharing

11. Termination

We may terminate your access to our Services:

  • With 14 days' notice for convenience

  • Immediately for breach of these Terms

  • Immediately for unprofessional conduct

  • If your account is inactive for 6+ months

11.3 Effect of Termination

Upon termination:

  • Your access to Services ceases

  • Confidentiality obligations continue

  • Ongoing placements and relationships remain in effect

  • Data retention follows our Privacy Policy

12. Dispute Resolution

12.1 Initial Resolution

For any disputes, we encourage:

  • Direct communication to resolve issues

  • Good faith negotiation between parties

  • Consideration of commercial interests

12.2 Formal Dispute Process

If informal resolution fails:
